About these Terms

These Terms of Service (“Terms”) govern the use of Ash’s Mod Bot, its website, its dashboard, and related features (together, the “Service”). The Service is operated by Russell Leedham (“we”, “us”, or “our”).

The Service operates through Discord but is not created, operated, sponsored, or endorsed by Discord Inc. Discord is a separate service with its own terms and policies.

When these Terms apply

You agree to these Terms when you directly use the Service, including when you:

add or authorise Ash’s Mod Bot in a Discord server;
use a command provided by the bot;
sign in to or use the web dashboard; or
configure, manage, or otherwise interact directly with the Service.

If you do not agree to these Terms, you must not directly use the Service. A server owner or authorised server manager can stop using the Service by removing the bot from their server.

A Discord server member may be affected by automated or moderator-triggered actions without directly using the Service. Being affected by one of those actions does not, by itself, mean that the member has agreed to these Terms. Our Privacy Policy explains how information may be handled when the bot is present in a server.

Eligibility and authority

You must meet Discord’s minimum age requirement for your country and otherwise be legally permitted to use Discord and the Service. If you are not old enough to agree to these Terms by yourself where you live, your parent or legal guardian must agree where required by law.

You must comply with Discord’s Terms of Service, Community Guidelines, and other policies that apply to your use of Discord.

If you add, authorise, or configure the bot for a server, you confirm that you own that server or have the server owner’s permission to do so. You must not attempt to manage a server through the dashboard unless you are authorised to manage it.

What the Service provides

Ash’s Mod Bot provides Discord server management and community features. Depending on the current version and server configuration, these may include:

automated moderation and configurable safeguards;
warnings, timeouts, kicks, bans, and moderation-history tools;
quarantine and role-restoration features;
command-access controls;
welcome and leave messages;
activity statistics, experience points, and levelling tools;
bot messages and other server-management tools; and
a website and server dashboard with owner-controlled delegated access.

Features may be added, changed, limited, or removed over time. The presence of a feature in this description does not guarantee that it will always be available or suitable for every server.

Free service and possible future paid features

The Service is currently provided free of charge.

We may introduce optional paid features in the future to support hosting, database, development, or other operating costs. Any paid feature will be clearly identified, and its price and any additional payment terms will be shown before a purchase is made. Continuing to use the free Service will not, by itself, create a charge.

Introducing a paid feature would not guarantee that every existing feature will remain free or unchanged. However, no payment will be taken without a clear purchase or subscription process. These Terms will be reviewed before paid features are introduced.

Responsibilities of server owners and managers

Server owners and authorised server managers are responsible for:

deciding which features to enable and how to configure them;
selecting appropriate permissions, roles, channels, limits, and exemptions;
ensuring that moderators are authorised and use commands appropriately;
reviewing important automated actions and correcting mistakes where appropriate;
ensuring that their use of the Service complies with Discord’s rules and applicable law; and
keeping control of the Discord accounts that can access their server settings.

The Service supports moderation but does not replace human judgement. Server owners and moderators remain responsible for moderation decisions made in their communities, including decisions made using information or tools supplied by the bot.

You should only grant the bot the permissions it needs. Missing permissions, Discord role hierarchy, channel restrictions, deleted roles, or changes made by another administrator may prevent a command or automated feature from working correctly.

Dashboard and delegated access

The Service includes a website and server dashboard accessible to server owners and other users within their authorised permissions. A server owner may grant and revoke access to supported settings for selected users or roles. Ordinary settings access does not automatically include permission to send messages through website Bot Messages. The server owner separately controls a server-wide mentions switch for /say and website Bot Messages; enabling it applies to all authorised senders in that server. Official service announcements have separate per-server mention preferences.

You must use only the access granted to you, keep account credentials and temporary access links private, and not transfer, share, or misuse those links. Temporary access is limited in scope and duration and ends when completed, cancelled, expired, or revoked. Possessing a link does not authorise use beyond its intended purpose or permitted scope.

Automated moderation and technical limitations

Automated systems can make mistakes. The Service may fail to detect unwanted behaviour, incorrectly flag permitted behaviour, be unable to complete an action, or produce incomplete or outdated information.

In particular:

automated rules cannot understand every context;
Discord permissions and role hierarchy may prevent moderation actions;
role restoration may be incomplete if roles have been deleted, changed, made unavailable, or placed above the bot’s highest role;
messages, interactions, or dashboard changes may be delayed; and
an outage or software error may temporarily affect some or all features.

Server owners and moderators should review significant actions rather than relying entirely on automation. We may provide notices explaining that an action was only partially completed, but those notices do not guarantee that every issue has been identified.

Acceptable use

You must not use or attempt to use the Service to:

violate applicable law, Discord’s rules, or the rights of another person;
harass, threaten, discriminate against, or deliberately target people through misuse of moderation features;
exploit a vulnerability or intentionally crash, disrupt, overload, or degrade the Service;
bypass access controls, permissions, rate limits, blacklists, restrictions, or security measures;
gain unauthorised access to another server, account, dashboard, database, or part of the Service;
submit malicious code, deceptive requests, or deliberately harmful data;
impersonate the developer or falsely claim that your server, service, or content is endorsed by Ash’s Mod Bot;
use automated accounts or repeated requests to place unreasonable demand on the Service;
evade a restriction by using another account or server; or
help another person carry out any prohibited activity listed above.

Accidentally discovering a technical issue is not, by itself, considered abuse. Good-faith vulnerability reports are welcomed and will not be treated in the same way as deliberate exploitation. Security research must not disrupt the Service, access other people’s information, or go beyond what is permitted by law. Suspected vulnerabilities should be reported privately to Miragedev21@gmail.com rather than exploited or publicly disclosed before there has been a reasonable opportunity to investigate them.

Misuse of messaging features

You must not use the Service to send, distribute, promote, or facilitate unlawful content or conduct, or content or conduct prohibited by Discord’s rules or these Terms. Prohibited uses include racist or other hateful conduct, bullying, harassment, threats, child exploitation or endangerment, and the unlawful sale, supply, or distribution of controlled substances.

We may restrict, suspend, or terminate access to messaging features or the Service, including by blacklisting the responsible user or server. Serious safety or security concerns may require immediate action without advance warning. Restrictions may cover bot commands, the dashboard, and temporary setup or settings links. The existing appeals process remains available.

Suspension and blacklisting

We may restrict, suspend, or blacklist a user or server where we reasonably believe this is necessary because of:

a serious or repeated violation of these Terms;
abuse, exploitation, attempted disruption, or a threat to the security of the Service;
evasion of an existing restriction;
harm or a credible risk of harm to the Service, its users, or third parties;
a requirement imposed by Discord, a service provider, a court, law enforcement, or applicable law; or
another comparably serious reason connected to the safe and lawful operation of the Service.

A server blacklist may cause the bot to leave the affected server. A user blacklist may prevent the affected account from using commands or other features across servers.

Serious cases may require immediate action without advance warning. Where appropriate and reasonably practical, we may instead give a warning or allow an issue to be corrected before applying a restriction.

Appeals

A blacklisted user or server owner may appeal by emailing Miragedev21@gmail.com. An appeal should include:

the relevant Discord User ID or Server ID;
an explanation of why the blacklist is believed to be incorrect; and
relevant evidence supporting that explanation.

Submitting an appeal does not guarantee a response, a response within a particular period, or removal from the blacklist. Restrictions may remain in place while an appeal is considered. Credible evidence that a blacklist was applied incorrectly will be considered where reasonably possible, and an incorrect restriction may be corrected.

Repeated, abusive, deceptive, or unsupported messages may not receive a response.

Third-party services

The Service depends on Discord and on third-party hosting, database, network, and infrastructure providers. Their outages, restrictions, policy changes, API changes, security measures, or discontinuation decisions may affect the Service.

We do not control Discord or those other providers and cannot guarantee their continued availability or compatibility. Your use of those services remains subject to their own terms and policies.

Links to third-party websites are provided for convenience. We are not responsible for third-party content, services, security, or privacy practices.

Privacy and submitted information

Our Privacy Policy explains what information the Service stores, why it is used, whether it is shared, and how removal can be requested.

You retain any rights you have in content or information that you submit. You give us permission to process that content and information only as reasonably necessary to provide, secure, maintain, and improve the Service, comply with applicable obligations, and enforce these Terms. This permission does not transfer ownership of your content to us.

You must not submit information through the Service unless you have the right or authority to do so. Where there is a specific and genuine reason to investigate serious abuse, protect the Service or its users, support an appropriate report to Discord or relevant authorities, respond to a valid lawful request, comply with a legal obligation, or establish, exercise, or defend legal claims, relevant information may be preserved for a limited period. Any such preservation should be limited to information reasonably relevant to the particular matter and is not intended to continue indefinitely.

Messaging accountability

Custom messages deliberately submitted through website Bot Messages or Discord /say may be recorded as described in the Privacy Policy. Records may be reviewed by the server owner and, where reasonably necessary, the developer for safety, misuse investigation, and enforcement of these Terms and Discord’s rules.

Users remain responsible for the content they submit and must have any necessary authority to share it. Audit records identify the account or authorised session used, not necessarily the person physically operating it. Records do not guarantee prevention of abuse or a particular outcome in a Discord enforcement appeal.

Intellectual property

Ash’s Mod Bot, its website, its original code, branding, interface, and original content are owned by or licensed to the developer, except for third-party materials and components belonging to their respective owners.

These Terms give you a limited, revocable, non-exclusive right to use the Service in accordance with these Terms. They do not transfer ownership of the Service or its intellectual property to you.

Nothing in these Terms prevents activity that applicable law expressly permits or overrides any licence that applies to an open-source component used by the Service.

Availability, changes, and maintenance

The Service is provided on a best-effort basis. We do not promise uninterrupted availability, a particular level of uptime, permanent retention of every feature, or immediate correction of every fault.

We may perform maintenance or change features, commands, limits, interfaces, permissions, or technical requirements. We will try to avoid unnecessary disruption, but maintenance may occasionally occur without advance notice.

We may also limit features where reasonably necessary to protect security, stability, legal compliance, or fair access to the Service.

Changes to these Terms

We may update these Terms to reflect changes to the Service, Discord’s requirements, applicable law, security needs, or operating practices.

Material changes may be announced through one or more appropriate channels, such as the website, dashboard, support server, or a notice sent to servers using the bot. Delivery to every server or user cannot be guaranteed, including where the bot lacks access to an appropriate channel.

Where reasonably practical, material changes will be announced before they take effect. Changes required urgently for security, legal compliance, Discord compliance, or another serious reason may take effect immediately.

The latest draft or effective version will display its revision date. Minor corrections or clarifications that do not materially reduce users’ rights may take effect when published.

If you do not agree to an updated version, you must stop directly using the Service and, if you manage a server, remove the bot from that server. Continuing to use the Service directly after updated Terms take effect indicates acceptance of the updated Terms.

Discontinuation

We may permanently discontinue all or part of the Service. Where reasonably practical, we will try to provide advance notice through the website, dashboard, support server, a server notice, or another appropriate channel.

Advance notice may not be possible where immediate discontinuation results from a security incident, legal requirement, Discord or provider decision, loss of essential infrastructure, or another circumstance outside our reasonable control.

If the Service is discontinued, information retained at that time will be handled in accordance with the Privacy Policy and applicable legal obligations.

Responsibility and liability

Nothing in these Terms excludes or limits responsibility that cannot lawfully be excluded or limited, including responsibility for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where the law prohibits such an exclusion.

We do not accept responsibility for loss or damage that:

was not reasonably foreseeable when you began using the Service;
was caused by your settings, your moderation decisions, unauthorised use of your Discord account, or your failure to follow these Terms;
resulted from Discord, another third-party provider, missing permissions, or another matter outside our reasonable control; or
could reasonably have been avoided by reviewing an automated action, maintaining appropriate server permissions, or following a warning provided by the Service.

Because the Service is currently free and provides supporting tools rather than professional moderation, you should not rely on it as the only protection for a server or as a guaranteed record of every event.

This section does not remove any mandatory legal rights or remedies that apply to you.

Ending your use of the Service

You may stop using the Service at any time. Server owners or authorised managers can remove the bot from a server, and users can stop invoking its commands or accessing its website.

Removing the bot does not immediately delete every record previously stored. Server settings and server-associated user records are archived for six calendar months after the bot leaves, unless deleted sooner following a valid request, and may be restored if the bot rejoins before expiry. Some information may not be immediately removable where it is still needed for an active feature, security restriction, genuine investigation, legal obligation, or another reason described in the Privacy Policy. Further data-removal options and requests are explained in that policy.

Sections that are intended by their nature to continue after use ends—including provisions concerning intellectual property, retained data, restrictions, responsibility, and disputes—may continue to apply where legally appropriate.

Governing law and disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer, this choice does not remove any mandatory legal protection you have under the law of the country where you live. Nothing in these Terms prevents a court or other body with lawful jurisdiction from dealing with a dispute.

Before starting formal proceedings, you are encouraged to contact Miragedev21@gmail.com with a clear explanation of the issue so that an informal resolution can be considered. This does not remove any right to seek urgent or formal legal remedies.

General terms

If any part of these Terms is found to be unlawful or unenforceable, the remaining parts will continue to apply so far as legally possible.

If we do not immediately enforce part of these Terms, that does not permanently waive the right to enforce it later.

Headings are included to make these Terms easier to read and do not change their meaning.
